1. Agreement to these Terms
These Terms of Use ("Terms") are a binding agreement between you and [LEGAL ENTITY NAME], doing business as Moving Company Hustle ("we," "us," or "our"), which operates Move ATX Right (the "Site"). By using the Site or submitting a form, you agree to these Terms and our Privacy Policy at /privacy/. If you don't agree, don't use the Site.
IMPORTANT: SECTION 15 REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT AS DESCRIBED IN SECTION 15.6.
2. What we are, and what we are not
The Site is an education and referral service. We provide general information about moving apartments in Austin, Texas, price benchmarks, summaries of public information about Texas moving regulations, and, on request, an introduction to a licensed moving company. We are not a moving company, motor carrier, household goods carrier, household goods broker, freight forwarder, or agent of any of them. We do not:
- perform, book, schedule, or arrange moves;
- set or negotiate prices;
- collect deposits or payments for moves;
- issue estimates, proposals, contracts, or bills of lading; or
- take possession of your belongings.
Moving companies we introduce you to pay us a referral fee. That fee doesn't change our educational content, price benchmarks, or legal information.
3. Estimates and information on the Site
3.1 Price ranges.
Price ranges shown on the Site are general benchmarks based on published rates and are not quotes, offers, or guarantees. Your actual price is set only by the moving company in its written proposal and contract and depends on facts the Site doesn't know.
3.2 Legal and regulatory information.
Information about Texas and federal moving laws is a general summary drawn from public government sources. It is not legal advice, may not reflect the latest changes, and may not fit your situation. Verify current rules directly with the Texas Department of Motor Vehicles (TxDMV) or the Federal Motor Carrier Safety Administration (FMCSA), and consult a licensed attorney for legal advice.
3.3 Building, neighborhood, and city information.
Information about apartment buildings, neighborhoods, events, weather, housing markets, and similar topics is provided for general reference, may change without notice, and may be incomplete. Building move-in rules, elevator reservations, certificate-of-insurance requirements, and fees are set by each property. Confirm them with your leasing office.
3.4 No reliance.
You are responsible for your own moving decisions. Don't rely on the Site as the only basis for any decision.
4. Moving Concierge
Moving Company Hustle may offer a Moving Concierge service in which we give informational guidance on vetting movers, reading estimates, and spotting red flags. Moving Company Hustle is not a mover, carrier, broker, or freight forwarder. Moving Concierge advice is informational only and is not legal advice. We do not book or arrange your move. No outcomes are guaranteed. You are responsible for verifying any mover's credentials and contract terms directly.
5. Introductions to moving companies
5.1 Independent businesses.
Moving companies we introduce you to are independent businesses. They are not our employees, agents, partners, or joint venturers. Any agreement for moving services is solely between you and the moving company.
5.2 Our screening is limited.
Before working with a moving company, we take reasonable steps to confirm that it holds an active TxDMV certificate and a USDOT number and reports carrying insurance. Licenses, insurance, and business practices can change at any time. We do not guarantee any moving company's licensing, insurance, performance, pricing, availability, conduct, or the safety of your belongings.
5.3 Your responsibilities.
Before hiring any mover, you should verify its TxDMV certificate number in TxDMV's database; get a written proposal and contract before loading; read the contract, including valuation and liability terms; and confirm your building's requirements.
5.4 Problems with a mover.
Claims about a move belong with the moving company. Texas law generally requires a written claim to the mover within 90 days of delivery for damage or billing disputes. You may also file a complaint with TxDMV or, for interstate moves, the FMCSA. We will cooperate reasonably with regulators, but we are not responsible for a moving company's acts or omissions.
5.5 No obligation.
Requesting an introduction does not obligate you to hire anyone.
6. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site's forms. The Site is intended for users in the United States.
7. Your submissions
You agree that information you submit is accurate and is about you, that any phone number you provide is yours or one you are authorized to use, and that you will notify us if your number changes. Don't submit information about another person without that person's permission, and don't submit sensitive data described in our Privacy Policy.
8. Communications and text message terms
8.1 Consent.
By checking the consent box on a form, you agree that we and the moving company we introduce you to may contact you by phone, text, and email about your request, including by automated means. Consent is not a condition of purchase. You may revoke consent at any time by any reasonable means, including replying STOP to a text, using an email's unsubscribe link, or contacting us.
8.2 Text message program.
Program name: Move ATX Right Move Requests. Messages relate to your move request, introduction, and quote. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, or HELP for help. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your mobile information.
8.3 Electronic communications.
You agree that we may provide notices, disclosures, and other communications electronically, and that these satisfy any requirement that they be in writing.
9. Acceptable use
You agree not to:
- submit false, fraudulent, or third-party requests;
- use the Site to harass anyone;
- scrape, copy, or republish Site content in bulk;
- use bots or automated tools to submit forms;
- interfere with or attempt to gain unauthorized access to the Site or its systems;
- introduce malware;
- use the Site to compete with us by reselling leads or content; or
- use the Site in violation of any law.
We may block access or reject submissions that we reasonably believe violate these Terms.
10. Intellectual property
The Site and its content, including text, guides, data compilations, graphics, photographs, logos, design, and code, are owned by us or our licensors and protected by intellectual property laws. You may view and print pages for personal, non-commercial use. Any other use requires our written permission. "Move ATX Right" and "Moving Company Hustle" are our trademarks. Third-party names and marks belong to their owners and are used for identification only, without implying endorsement. If you send us feedback or building information, you grant us a perpetual, royalty-free right to use it without compensation to you.
10.1 Copyright concerns.
If you believe content on the Site infringes your copyright, send a notice to [COPYRIGHT AGENT NAME AND EMAIL] that includes the information required by 17 U.S.C. § 512(c)(3).
11. Third-party sites and content
The Site links to government agencies, moving companies, and other third-party sites. We don't control them and aren't responsible for their content, accuracy, practices, or availability. Statistics and data from third-party sources are cited as published and may be revised by their publishers.
12. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT INFORMATION IS COMPLETE OR CURRENT, OR THAT ANY MOVING COMPANY WILL PERFORM AS PROMISED.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING FROM OR RELATED TO THE SITE, THE CONTENT, ANY INTRODUCTION, OR ANY MOVING COMPANY'S SERVICES; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). These limits apply to any theory of liability, even if we were advised of the possibility of such damages. NOTHING IN THESE TERMS LIMITS OR EXCLUDES ANY LIABILITY OR RIGHT THAT CANNOT BE LIMITED OR WAIVED UNDER APPLICABLE LAW, INCLUDING RIGHTS UNDER THE TEXAS DECEPTIVE TRADE PRACTICES-CONSUMER PROTECTION ACT THAT CANNOT BE WAIVED, OR LIABILITY FOR OUR GROSS NEGLIGENCE, FRAUD, OR WILLFUL MISCONDUCT.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or information you submit that is false or that you weren't authorized to submit.
15. Dispute resolution and arbitration
15.1 Informal resolution first.
Before starting arbitration or a lawsuit, you and we agree to try to resolve any dispute informally for 30 days. To start, send a written notice describing the dispute and the relief requested: to us at [LEGAL EMAIL] and [MAILING ADDRESS], or to you at the contact information you provided.
15.2 Agreement to arbitrate.
If the dispute isn't resolved informally, you and we agree that any dispute, claim, or controversy arising out of or relating to the Site or these Terms will be resolved by binding individual arbitration under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, available at adr.org. The arbitrator decides all issues, except that a court decides questions about the validity, scope, or enforceability of Section 15.4. We will pay all AAA filing, administration, and arbitrator fees for claims of $10,000 or less, unless the arbitrator finds your claim frivolous. Arbitration will take place in Travis County, Texas, or by video or written submissions, at your choice.
15.3 Exceptions.
Either party may bring an individual claim in small-claims court if it qualifies. Either party may seek injunctive relief in court for misuse of intellectual property. Nothing in this section prevents you from filing a complaint with a government agency, such as TxDMV, the FMCSA, the Federal Trade Commission, or the Texas Attorney General.
15.4 Class action and jury trial waiver.
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If this class action waiver is found unenforceable for any claim, that claim must be decided in court, not arbitration, and the rest of this Section 15 still applies to other claims.
15.5 Severability.
If any part of this Section 15 is found unenforceable, the rest remains in effect, except as stated in Section 15.4.
15.6 Your right to opt out.
You may opt out of this arbitration agreement by emailing [LEGAL EMAIL] within 30 days after you first submit a form on the Site. Use the subject "Arbitration Opt-Out" and include your name, email, and phone number. Opting out doesn't affect any other part of these Terms.
16. Governing law and venue
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas, except where the law gives you the right to bring a claim where you live.
17. Changes and termination
We may change these Terms by posting an updated version with a new "Last updated" date. Changes apply going forward and don't apply to a dispute already pending. If a change is material, we will post notice on the Site before it takes effect. Your continued use after that means you accept the change. We may suspend or end access to the Site at any time. Sections 3, 5, and 10 through 19 survive termination.
18. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only. Neither party is liable for delays caused by events beyond its reasonable control.
