1. Who we are
Move ATX Right (the "Site") is operated by [LEGAL ENTITY NAME], doing business as Moving Company Hustle ("Moving Company Hustle," "we," "us," or "our"), [MAILING ADDRESS]. We are the controller of personal data collected through the Site. Move ATX Right is an education and referral service. We are not a moving company, motor carrier, household goods broker, or freight forwarder, and we do not perform, book, or arrange moves.
This Privacy Policy explains how we collect, use, disclose, and protect personal data when you visit the Site, submit a form, or communicate with us. It applies alongside our Terms of Use at /terms/.
2. Information we collect
2.1 Information you give us
When you use our estimator, quote request, mover introduction, Moving Concierge, or privacy request forms, we collect what you enter. Depending on the form, this may include:
- Identifiers and contact details: name, phone number, email address, and your preferred contact method.
- Move details: move date, date flexibility, origin ZIP code, destination ZIP code or city, unit size, building or complex name, floor numbers, elevator access, parking or loading access, certificate-of-insurance needs, packing needs, storage needs, special items, and any notes you write.
- Consent records: whether you checked a consent box, the exact consent language shown, the date and time, and the page where you gave it.
- Communications: messages you send us and records of our calls, texts, and emails with you.
2.2 Information collected automatically
When you visit the Site, we and our service providers automatically collect:
- Device and connection data: IP address, browser type, device type, operating system, and approximate location derived from IP address (city or region level, not precise location).
- Usage data: pages viewed, links clicked, time on page, referring website, and the date and time of your visit.
- Campaign data: marketing parameters in the page address (such as utm_source, utm_medium, and utm_campaign) and the page that referred you.
- Cookies and similar technologies, as described in Section 7.
2.3 Information from others
We may receive information about you from the moving company we introduce you to, such as whether it reached you, whether you booked, and any feedback, so we can measure and maintain service quality.
3. Sensitive data
We do not intentionally collect sensitive data as defined by the Texas Data Privacy and Security Act, including data revealing racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexuality, citizenship or immigration status, genetic or biometric data, precise geolocation data, or personal data of a known child. Please don't include this kind of information in form notes or messages. If you need an accommodation for your move (for example, accessibility needs), describe the practical requirement, such as "needs ground-floor walkthrough," instead of a medical condition.
We do not sell sensitive personal data or biometric personal data.
4. How we use information
We use personal data to:
- Calculate and display price ranges you request.
- Review your request and introduce you to a licensed Austin moving company.
- Contact you about your request by phone, text, or email, as you consented.
- Provide Moving Concierge services you request.
- Respond to questions, complaints, and privacy requests.
- Keep records of your consent and communication preferences, including opt-outs.
- Measure how the Site performs and improve our content and forms.
- Measure and maintain the quality of moving companies we work with.
- Detect, prevent, and respond to fraud, spam, abuse, security incidents, and illegal activity.
- Comply with legal obligations and enforce our Terms of Use.
We do not use personal data for profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
5. How we disclose information
5.1 To the moving company you ask us to introduce you to
When you submit a quote request or ask for an introduction, we disclose your contact information and move details to one licensed Austin moving company we select for your move, so it can contact you and prepare a written estimate. That moving company pays us a referral fee. The moving company is an independent business and its own controller of the data we share. Its use of your data is governed by its own privacy practices. We require the moving companies we work with to use your information only to respond to and service your move request, to honor opt-out requests, and to comply with applicable telemarketing and privacy laws.
5.2 To service providers
We use service providers (processors) that handle data on our behalf under contracts requiring them to protect it and use it only to provide services to us. These include:
- Form processing: Formspree.
- Website hosting: Replit.
- Web fonts: Google Fonts, which receives your IP address when the Site loads fonts.
5.3 For legal reasons
We may disclose information if we believe in good faith it is necessary to comply with law, legal process, or a government request; to protect the rights, property, or safety of you, us, or others; to investigate fraud or security issues; or to enforce our Terms of Use.
5.4 Business transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal data may be transferred as part of that transaction, subject to this Privacy Policy.
5.5 With your direction
We may disclose information to other parties when you direct us to.
5.6 Sale of personal data
Under the Texas Data Privacy and Security Act, a "sale" does not include disclosing personal data to a third party for the purpose of providing a product or service you requested. Disclosing your move request to the moving company you asked us to introduce you to is done to provide the service you requested. Even so, because we receive a referral fee, we give you a clear choice: if you don't want your information shared with a moving company, don't submit a quote or introduction request, or contact us at /privacy-choices/ and we will not make an introduction for you. We do not sell personal data to data brokers, and we do not sell sensitive personal data.
6. Calls, texts, and email
6.1 Your consent
We and the moving company we introduce you to will call, text, or email you only as you consent when you submit a form. Consent may include calls and texts using automated technology. Your consent is not a condition of buying any goods or services. You may use the Site's educational content without giving consent.
6.2 Text messages
If you consent to texts, you may receive messages about your move request, introduction, and quote. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts from us at any time, and reply HELP for help. Opting out of our texts does not opt you out of texts from a moving company you have been introduced to. Reply STOP to that company's messages as well, or contact us and we will forward your opt-out. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or text-messaging consent with any third party for that party's own marketing, except the moving company you ask us to introduce you to, for the sole purpose of contacting you about your move.
6.3 Email
Our emails identify us, include our mailing address, and include a working unsubscribe link. We honor unsubscribe requests promptly and within the time required by the federal CAN-SPAM Act.
6.4 Do-not-call
We maintain an internal do-not-contact list and honor opt-out requests made by any reasonable means. We do not make cold sales calls or send cold marketing texts. We contact only people who have submitted a request and consented.
7. Cookies, analytics, and Global Privacy Control
We use cookies and similar technologies that are necessary for the Site to work, and we do not currently use analytics or advertising cookies. We do not currently use advertising cookies or pixels, and we do not engage in targeted advertising.
Most browsers let you block or delete cookies. Blocking necessary cookies may affect how the Site works.
We honor Global Privacy Control (GPC). When your browser sends a GPC signal, we treat it as a request to opt out of the sale of personal data and targeted advertising for that browser, and we do not load advertising pixels for that browser. Learn more at globalprivacycontrol.org.
8. Your privacy rights
8.1 Rights we honor for everyone
Regardless of where you live, you may ask us to:
- confirm whether we process your personal data, and access it;
- correct inaccuracies in it;
- delete it;
- get a copy in a portable, readily usable format; and
- opt out of the sale of personal data, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects.
Texas residents have these rights under the Texas Data Privacy and Security Act. Residents of other states may have similar rights under their state's laws, and we honor them as well.
8.2 How to submit a request
Submit a request through our form at /privacy-choices/ or email [PRIVACY EMAIL, e.g., privacy@DOMAIN.com]. We will verify your request by matching information you give us (such as your email address and phone number) with our records. We won't ask you to create an account. We may ask for more information if we can't verify your request. We will use information you give us for verification only for that purpose.
You may use an authorized agent to submit a request for you. We may require proof that the agent is authorized and may ask you to verify your identity directly.
8.3 Our response
We respond to verified requests within 45 days. If reasonably necessary, we may extend that by 45 more days, and we will tell you within the first 45 days. Requests are free of charge up to twice a year. We may decline requests that are manifestly unfounded, excessive, or repetitive, or that we can't verify, and we will explain why.
8.4 Appeals
If we decline your request, you may appeal by replying to our decision or emailing [PRIVACY EMAIL] with "Privacy Appeal" in the subject line. We will respond to your appeal within 60 days with a written explanation of our decision. If we deny your appeal, you may contact the Texas Attorney General at texasattorneygeneral.gov to submit a complaint.
8.5 No discrimination
We will not deny you services, charge you a different price, or provide a different level of quality because you exercised your privacy rights. If you ask us to delete your data or not to share it with a moving company, we won't be able to make an introduction for you.
9. How long we keep information
We keep personal data only as long as reasonably necessary for the purposes in this policy:
- Move requests and related communications: up to 24 months after your last interaction with us.
- Consent records and opt-out records: up to 5 years, so we can prove consent and honor your opt-out.
- Privacy request records: up to 24 months after we resolve the request.
- Site usage data: up to 26 months.
We may keep data longer if the law requires it or to resolve disputes, and we delete or de-identify data when it is no longer needed. When we de-identify data, we take reasonable measures so it cannot be associated with you, publicly commit not to re-identify it, and contractually require anyone who receives it to do the same.
10. Security
We use reasonable administrative, technical, and physical safeguards appropriate to the volume and nature of the data we hold, including encrypted connections (HTTPS), access controls, and limiting access to people who need it. No method of transmission or storage is completely secure. If a breach of system security affects your personal data, we will notify you and regulators as required by applicable law, including Chapter 521 of the Texas Business and Commerce Code.
11. Children
The Site is intended for adults 18 and older. It is not directed to children, and we do not knowingly collect personal data from anyone under 18. If you believe a child has given us personal data, contact us and we will delete it.
12. Links to other sites
The Site links to government agencies, moving companies, and other websites. We are not responsible for their privacy practices. Review their policies before giving them information.
13. Changes to this policy
We may update this Privacy Policy. We will post the updated version with a new "Last updated" date. If we make material changes in how we use or disclose personal data, we will give notice on the Site before the change takes effect and, where required by law, ask for your consent.
